RED ROOSTER 25 DAYS OF CHRISTMAS PROMOTION

TERMS AND CONDITIONS

  1. Information on how to enter and the 25 Days of Christmas promotion (the Promotion) forms part of these Terms and Conditions. Participation in the Promotion is deemed acceptance of these Terms and Conditions. The promoter is Red Rooster Foods Pty Ltd (ABN 51 008 754 096) of Level 12, 12 Help Street, Chatswood NSW 2067, telephone 02 8905 8400 (the Promoter).
  2. Entry is only open to Australian residents aged 13 years or over who are (or become) fully verified members of the Red Rooster Royal Rewards Program and have opted in to receive communications from the Promoter (each a Red Royalty Member). Details of the Red Rooster Royal Rewards Program are available at [link].
  3. Red Royalty Members under 18 must have parental/guardian approval to enter, and the parent/guardian of the Red Royalty Member must read and consent to these Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to the minor entering the Promotion.
  4. Employees (and their immediate families) of the Promoter and agencies associated with the Promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
  5. Entries in the Promotion open at 12:00am AEDST on 29/11/2021 and close at 11:59pm AEDST on 24/12/2021 (Promotional Period).
  6. Every Monday during the Promotional Period, the Promoter will upload 25 Days of Christmas offers to each Red Royalty Member’s loyalty account in the form of a redemption code (each an Offer). All Offers are valid for seven days from the date they are uploaded. Offers can only be redeemed individually. The redemption code will appear in the Red Rooster app or in the web account https://www.redrooster.com.au/redroyalty/signin/.
  7. To enter the Promotion, an entrant must be a Red Royalty Member when undertaking any one of the four following qualifying transactions during the Promotional Period (each a Qualifying Transaction):
  • In-Store Purchase: Redeem an Offer, following a minimum spend of $10, in a single order, at a Red Rooster Store and must identify as a Red Royalty Member by scanning their Red Rooster App or providing their account mobile number at the time of their transaction; or
  • Drive-Thru Purchase: Redeem an Offer, following a minimum spend of $10, in a single order, at a Red Rooster Drive-Thru and must identify as a Red Royalty Member by scanning their Red Rooster App or providing their account mobile number at the time of their transaction; or
  • Delivery Purchase: Redeem an Offer, following a minimum spend of $25, in a single order, on Red Rooster Delivery using the entrant’s Red Royalty membership details at the time of redeeming the Offer. Delivery Purchases can be made via the Red Rooster App (available for download via Google or the App Store) or online at orders.redrooster.com.au only, provided that orders made through third party channels such as Menulog, Uber Eats, Doordash and Deliveroo are excluded from the Promotion; or
  • Click & Collect Purchase: Redeem an Offer, following a minimum spend of $10, in a single order, on Red Rooster Click & Collect using the entrant’s Red Royalty membership details at the time of redeeming the Offer. Click & Collect Purchases can be made via the Red Rooster App (available for download via Google or the App Store) or online at orders.redrooster.com.au only.
  1. Upon completing a Qualifying Transaction, the Red Royalty Member will be awarded one automatic entry in the relevant weekly draw for an eGift Card and a Surprise and Delight prize (as detailed below) and one automatic entry in the grand prize draw (as detailed below).

Weekly Draw

  1. There will be four (4) weekly prize draws (each a Weekly Draw). Entries open and close for each Weekly Draw on the dates and at the times listed in the table below. All draws will take place, by random electronic selection, at Anisimoff Legal, Suite 5/210 Central Coast Hwy, Erina NSW 2250 at 11:00am AEDST on the dates listed in the table below. Entries in a Weekly Draw will NOT be entered in any other Weekly Draw. The Promoter may draw additional reserve entries and record them in case an invalid entry is drawn. Winners will be notified by email. The names of any winners will be announced online at https://www.redrooster.com.au/25-days-of-christmas-22-winners/ following the draw date.

  1. The first one hundred (100) valid entries drawn in each Weekly Draw will each win a $50 Prezzee eGift Card (eGift Card).
  2. Any ancillary costs associated with redeeming an eGift Card are not included. Redemption of an eGift Card is subject to any terms and conditions of the issuer, including those specified on the eGift Card.
  3. If the winner of an eGift Card is under the age of 18, the card will be awarded to the winner’s nominated parent or guardian on the winner’s behalf.

Grand Prize

  1. The main prize for the Promotion consists of: (1) a $10,000 Holiday Voucher issued by Flight Centre Australia, (2) Red Rooster for a year ($200 x 12) and (3) a merchandise pack (value $250)  selected by the Promoter (collectively the Grand Prize).
  2. The draw for the Grand Prize will take place, by random electronic selection, at Anisimoff Legal Suite 5/210 Central Coast Hwy, Erina NSW 2250 at 11:00am AEDST on 10/1/2022.
  3. The Promoter will announce and attempt to contact the Grand Prize winner on 10/1/2022.
  4. The $10,000 Holiday Voucher is redeemable at Flight Centre Australia in store or by phone, but not online, and is valid for one year from the date of issue.
  5. Red Rooster for a year will be awarded by uploading a $200 credit to the winner’s Red Royalty account each month for 12 months. Each uploaded credit is valid for any Red Rooster purchase made within 30 days after the date of uploading.

General

  1. Multiple entries are permitted, subject to the following: (a) only one entry is permitted per Qualifying Transaction regardless of the amount spent in that Qualifying Transaction; and (b) each entry must be submitted separately and in accordance with entry requirements.
  2. The Promoter reserves the right, at any time, to verify the validity of entries and Red Royalty Members (including a Red Royalty Member’s identity, age and place of residence) and to disqualify any individual the Promoter considers has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Promotion.  Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  3. Incomplete orders or cancelled orders will be deemed invalid unless the Promoter elects to waive the error or omission in the particular case.
  4. The Promoter’s decisions in relation to eligibility to participate in the Promotion and the conduct of the Promotion otherwise are final and no correspondence will be entered into.
  5. Subject to any draw for unclaimed prizes pursuant to clause 27, if for any reason a winner does not claim or use a prize at or within the time stipulated in these Terms and Conditions, the Promoter may declare the prize forfeited.
  6. If any prize offered in the Promotion is unavailable, the Promoter, in its discretion, reserves the right to substitute a prize of equal value or specification for the prize that is unavailable, subject to applicable law or regulation.
  7.  No prize or part of any prize offered in the Promotion (including any unused balance on an eGift Card) is transferable or exchangeable and cannot be taken as cash.
  8. The Promoter may, at its discretion, conduct a draw for any unclaimed prizes on 06/04/2022 at the same time and place as the original draw, subject to applicable law or regulation. Winners, if any, will be notified in writing by email. The names of any ACT winners will be announced online at 25daysofchristmas.redrooster.com.au on 20/04/2022.
  9. Red Royalty Members consent to the Promoter using their name, likeness, image or voice in the event they are a winner (including photograph, film or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting the Promotion (including any outcome), and promoting any products manufactured, distributed or supplied by the Promoter.
  10. If the Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any Red Royalty Member; or (b) subject to any applicable law or regulation, to modify, suspend, terminate or cancel the Promotion, as it considers fit.
  11. Any cost associated with accessing the Promotion website or the Red Rooster App is the Red Royalty Member’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or other mechanical or electronic means that enables a Red Royalty Member to automatically enter more than once for each Qualifying Transaction is prohibited and will render all entries submitted by that Red Royalty Member invalid.
  12. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act or any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (Non-Excludable Guarantees). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including for negligence) for any personal injury; or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including without limitation all liability arising out of: (1) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (2) any theft, unauthorised access or third party interference; (3) any entry or prize claim being late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter); (4) any variation in prize value to that stated in these Terms and Conditions; (5) any tax liability incurred by a prize winner, or (6) the use of a prize.
  13. The Promoter collects personal information (“PI”) in order to conduct the Promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry in the Promotion is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.redrooster.com.au/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Red Royalty Member. The Privacy Policy also contains information about how Red Royalty Members may opt out, access, update or correct their PI, how Red Royalty Members may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter may disclose PI to overseas recipients (e.g.for data storage/processing/marketing) however it is not practicable to specify the countries those overseas recipients are likely to be in.
